    Question Wrong Officer's Name Was Listed on the Docket Sheet

    My question involves traffic court in the State of: Pennsylvania

    I had no idea of the name of the officer that pulled me over for rolling through a stop sign. It was dark and he scribbled his name on the ticket. I get the docket sheet and it states the arresting officer's name. I went to the magistrate today and the right cop was there, but that wasn't his name. He let me amend it to a lesser charge with no points which added $50 on the fine. But even the judge knew it was incorrect. In every case that went before me, the judge said the defendants name and the cops name. In mine, he said my name, looked at the guy who stood up and when he realized it wasn't the cops whose name was on his form (small town), he just stopped. Never said that dudes name. Does this make any difference? I already agreed to the lesser charge but the docket sheet still says the wrong name.

    You did say the cop that have you the ticket was the cop there in court.

    Not really understanding your problem.

    So if you have no idea of the name of the officer because he scribbled it but he was there in court, how do you know the court had the wrong name? Did it not look anything like the scribble? My signature often looks nothing like my actual name. It could also have been an error by the court when docketing it and the judge realized it because he's familiar with the officers.

    Either way, it doesn't do you any good.

    All that was necessary was that the cop who observed the violation was there to testify as to what he observed. Since you say that was the case you would not have gotten the case dismissed over this.

    The cop whose name is listed on the court papers as the arresting officer was not the cop who showed up.

    And, as you've been told, it doesn't matter. Even if it were an issue, it would be mooted by the fact that you chose to plead guilty -- but it isn't an issue, as the correct officer was present and prepared to testify.

    The court's docket is a document it uses to organize and schedule the cases it's hearing in a given day. That's all. The officer could have been listed as "Bozo the Clown" and you still wouldn't have any basis for relief based on the error.

    This situation indicates a clerical error. If the correct officer was there in court, you're done. It actually sounds like you got a pretty good deal.
