    Default Duties and Hours Have Increased but Wages Have Not

    My question involves labor and employment law for the state of: Arizona

    I will try to make this short. Me and my husband work for a property management company. I am the onsite manager and he is maintenance. We are the only employees on site. This is the 3rd management company we have had here at the complex. (the owner wanted us to stay)

    Now I work at least 20 hours a week and my husband works 30+. When we were first hired on by the original management company we were told this was a part time position and our pay was $400 a month plus our apartment. The apartment is $800 a month with utilities included. But as time has gone on our workload has too. I have more work that I was not doing before and my husbands hours have gone up. But yet our pay has not. If we calculate our hours and the pay we are getting (including the rent), we are making a little less than $6 an hour. Now with none of these management companies have we signed a contract or anything. Is this legal for how much they are paying us? Or are we pretty much screwed and need to start looking for better employment? We feel we are being taking advantage of and think that this is not right. When we were first hired on we were told we had to have some other form of employment, but now that is not the case.

    Is there anything we can do?

    Well we asked the owner of the property first. And he said he couldnt afford it. (yet he makes $10,000 profit a month) Yeah a joke. And I broke it down for the management company too and all they said was they could send us to other properties for more work. That really doesnt justify the pay we are getting here.

    Arizona's minimum wage is $8.05.

    I don't really have the time to research state and federal law to see if your employer is exempt. He probably isn't.

    But the best and fastest way to get advice about your situation is to call or email Arizona's regulatory agency and explain it just the way you've explained it here:

    Ok thank you I will email them. I dont know what would make the company exempt. I know they have at least 25 apartment complexes that they manage so they probably have over 50 employees. Not sure. But thank you, I will email them and see what they say.

    Then they are almost certainly not exempt.

    Since you've already been "shined on" by the owner and the management company, be prepared to file an official wage claim with the state.

    Then be prepared to be out of a job shortly thereafter. Yes, it's illegal to retaliate against you for filing a wage claim but the reality is that they will find a subtle way of terminating your employment at some future date that will be unrelated to your wage claim.

    Either be prepared for all that or just start looking for another job and another place to live.

    Well we are looking for another job currently anyways. We are just tired of being taken advantage of. We have helped the owner of this property allot. And have gone above and beyond. The last company was not doing their job and we had to make the owner aware of it. And we have saved him allot of money, but yet get nothing in return. Thank you for all your help!

    Keep in mind that you can still seek back wages even after you've left the company.

    Yeah the previous management company was even larger. So I am assuming more than likely they are not exempt either....
