    Default Non-Custodial Parent Moving Out of State

    My question involves a child custody case from the State of: Nevada

    I am the non-custodial parent and am thinking of moving back to my home state of Oklahoma. I have visitation with my child every other weekend. There is a custody order in place stating my visitation schedule. My question is if I decide to move out of state what is the likelihood that the court will allow me to modify the court order to a long distance schedule and also allow my child to come see me? I plan to pay for the visits and since he is still fairly young plan to fly to pick him up and take him back. I know my ex-husband will give me a hard time so just wondering what my options are.

    I think you have an excellent chance of modifying the order. As long as he's over 5 he can fly UM, and since you're going to absorb the cost yourself I can't see how Dad can really fight against it.

    Thank you for your response. I do not have a supervised schedule and have not had one for two years or more. The only reason I did in the past is because of the person I was with which is no longer an issue. Can my ex-husband ask the court to not allow my child to be taken out state for visitation for any reason or does he have to prove that in some way it would not be in the child's best interest? Which, honestly, there isn't anything he could prove. I'm not sure the court would even take in consideration the relationship that has already been established between my child and I?

    Yes, he can ask. He can ask for just about anything, but that doesn't mean he'll get what he wants.

    You already have unsupervised visitation, yes? Overnights, too? Then the court has no reason to deny you a long-distance parenting plan. I can understand your worries but try not to overthink this one.

    Yes, I have unsupervised visits and overnights. I've just already been through a lot with him about custody so yes, I do over think it. (Laughing) thank you again!
