    Default Can You Break Your Lease Over Noise Issues

    My question involves landlord-tenant law in the State of: New Mexico

    First of all sorry for my language. English is my second one.

    I've lived at many apartments. Some of them were really old - once I lived at an 100 years old house. There were some issues. With noise as well. However, I'm an unpretentious person. I understand that it is not possible to completely insulate a house from noise. So, I've never complained.

    But the place where I currently live is standing out. It has zero noise insulation. I hear every sound that my neighbors make like they'd live in the same room with me. I've known many private things about people who live next to me, even I do not want to. My upstairs neighbor goes to bed at 3:30 am. Before that she walks. Floors squeak so loudly that I get awaken every time she steps. Unfortunately, she cannot fly. Another neighbors get up at 5:30. I literally hear every word they pronouns. I am even able to hear there phone even it is in a soundless (vibration) mode. I have to admit, that all of us who live at the apartment complex are pretty quiet people who try to produce as less noise as we can. So, I do not blame my neighbors. The issue is with the wrong construction of the house.

    As a result I've not been sleeping well for three months still I settled here. Literally 2-3 hours a day. Always want to sleep. Recently almost got asleep while was driving. I have not been sleeping last three nights in a row at all because my upstairs neighbor did not slept till morning and walked all the night time. Yesterday I had a high blood presser attack for the firs time at my life.

    Landlords say they cannot fix construction how houses were built. They just get annoyed with "unreasonable" requests. They refused to break a rent agreement without charging a two-months payment fee.

    I've carefully learned this topic in the Internet. It seems that I have nothing to do with this situation but pay fee and save my health getting out of there. Low is completely at landlords side.

    Before I do so I would like to ask your advice. May be there is a chance to break rent without charging fee. Isn't a quality of a house a part of serves that landlords provide?

    Is there a Government Organization that watch apartments condition where I could ask for help? Only I was able to find was hud.gov. But it seems like they cannot influence somehow on companies which provide poor service.

    Is this an actual apartment building or a house converted into apartments? If its a house converted into apartments your only hope would be if it was an illegally converted house and you got the city involved.

    Thank you. It's an actual apartment complex of buildings. I see that I do not have any rights to break lease. Only I can do is to leave as many negative feedbacks on Yelp, Google and other sources as I can.

    Beware what leaving bad reviews can do for your relationship with your landlord before you move out.

    We had a person post here recently about leaving a bad review for a landlord that had, up to that point, been working with them over late rent payments. Bad move.

    Thanks for advise. I always pay at a proper time though. In this case for a horrible service. BTW, this company got several one star feedback in a row during last months on Google.
