    Default How to Evict a Relative Who Won't Move Out

    My question involves landlord-tenant law in the State of: New Jersey

    My mother-in-law is having problems with her adult granddaughter who has lived with her for the last several years and refuses to move out. It sounds absurd but the 25 year-old has a full-time job and yet doesn't pay a dime toward rent or food. She has recently become quite unreasonable, bordering on verbally abusive, with her grandmother who reluctantly asked her to start looking for her own place. The 25 year-old refused to even discuss moving. The granddaughter is not on the lease and the grandmother is unsure where to go to force removal. Is this a landlord-tenant issue (County Court-Special Civil Part), or is this type of matter handled in Family Division (Court)? Thank you.

    Unless the kid raises the bar and takes her actions into the criminal world this is a matter dealt with under landlord tenant law.

    If you are where you can keep an eye on things I would suggest being even closer when kid gets served with a notice to terminate the tenancy and the at the end of that time, if she has not left, the notice she is being sued to evict her.

    Resesrch the landlord tenant laws so the grandmother does things correctly. Making errors can prolong the action.
