Default Delay in Results from Employment Background Check Through the Department of Justice

My question involves labor and employment law for the state of: California

Hello! I was recently offered a job for a senior living facility in Southern California. I accepted this offer and was told I had to get a livescan fingerprint report done to complete a department of justice and FBI background check which would then bfe sent to the department of social services to clear me for work. I had the fingerprints done on 12/10/2015 and as of today my background check is listed as "delayed". The only thing on my record is a "traffic: failure to appear" misdemeanor from 2010, which the department of social services says can be waived as it is over 5 years old and nonviolent, but they can't do anything until the DOJ sends their final check to them. Could this be what is causing a status of "delay" on my background check? I also had a fake ID ticket which was completely expunged and does not show up on any criminal background check including government ones. My to-be employer is now saying that they cannot wait any longer to fill the position and are going to pull their offer. Is there anything I can do about this situation? I've tried talking to anyone I can get in contact with at the DOJ but I cannot get through to anyone and get an answer on what exactly is causing this delay. I can't believe I might have a job offer pulled from me due to the DOJ failing to process this report in a timely manner, but it looks like that may be what's happening here...

It has been years since I was involved in hiring, but DOJ has always been notoriously slow when it comes to processing prints.

When working with DOJ you truly learn the meaning of "Hurry up and wait."

You might try making a call to your local Senator or Assembly person. An inquiry from them usually spurs a state agency to expedite the handling of matters for an individual.
