    I do not know how big the company is, but if it is large company it would cause a lot of confusion if you send them money that they are not pursuing. In fact, the money might not even be applied properly even if they cash your check. You might end up having to go through all kinds of legal hoops anyway to prove that you repaid them.

    I would recommend putting the money aside in a savings account until they actually ask you for it if they are a large company. If they are a small or smaller company I would not give them the money until or unless they are willing to exchange a written release of the debt in exchange for the check.

    I guess the only thing that I am still confuse about is if I would have to pay them more than the amount owned in case they decide to sue me. There is nothing in the contract mentioning interesest, court or attorney fees. My understanding is that, in this scenario I am not responsible for paying them these costs if I just agree to pay them back the original owned amount. Is that correct?

    The way my previous resignation worked;
    At my last day, an exit interview would take place. During this time, a waiver was signed. This would be the time the employer SHOULD be discussing the relocation reimbursement (or tuition reimbursement, in some cases). It sounds like their HR department is in serious disarray, or their process is garbage.

    There have been instances where a current or former employee will have been overpaid. In which case, a letter is mailed to that individual requesting reimbursement. If reimbursement is not received, the matter is handed over to Collections.
