My question involves bankruptcy in the state of: Texas. If the state median income for your state is lets say, 44000....but your income is 22000...Do you automatically qualify for chapter 7, regardless of disposable income?
The question of whether your current monthly income is less than the state's median family income is a separate question from whether you are disqualified from Chapter 7 bankruptcy due to your having a high disposable income. If your disposable income is high enough, despite your low income, you would be presumed capable of repaying part or all of your debt.
And when you say high enough, what is the ball park of that amount? Disposable income is amount left after expenses, correct? And if you expect expense increases and put that on the petition, is it likely to overlook current disposable income becuase of the fact that when your expenses increase, your disposable income will be significantly smaller?
