Default Applying for Citizenship When Married to an Undocumented Immigrant

I am a greencard holder and recently qualify to become a US citizen. I am married to my husband for two years and we have a son. Unfortunately, my husband is undocumented. How should I classify him in my citizenship application form? That is the only thing I am missing in order for me to submit it. Please someone enlighten me.

Read this article from elsewhere on this company's sites. Pretty much answers your question outright: http://www.nolo.com/legal-encycloped...-lives-me.html

You should consult an immigration attorney. the fact you are married to an illegal may present a bar to you obtaining citizenship by your intentional and ongoing involvement in the violation of US law. It is also potentially likely you submitted false paperwork and lied to USCIS, creating a permanent ban for yourself.

It could in some stretch of the imagination, but it really has not been used that way in any way that I've heard publicized. Putting down ALIEN in the "immigration status field" has neither seemed to impede the naturalization process nor has it been used to direct attention to the illegal spouse.

But the advice to speak to an attorney who knows how things are rather than relying on the personal biases of people on the forum with axes to grind is a good recommendation.

You know nothing about us to say that we don't have respect in the law. In case you haven't notice, we are trying to make everything right that's why i am here asking theright thing to do. As far as Weare concerned, wedid not violate any law for falling in love. You may be lucky for not having the same worries as we have but you know what, pulling us more down will not help you in your problems either. If you're going to talk about respect, you should know how torespect other'sfeeling too.

If you are "in love", where you live is not important.

You should have foreseen the problems becoming involved with someone with a checkered immigration history. Love cannot conquer all.

It is frustrating to see people get themselves into situations which are known to have significant issues and then expect to be so special as to have an easy way out. You chose your path and not you need to live with the bumps in the road and realize that there may be no solution that you would like to the problem.
