    Unhappy Short marriage, does he still get my retirement?

    My husband and I have been married for 5 months. I finished school and got an awesome job as an operator at a refinery. He quit his job shortly after, and has started partying alot now with my $. So....... If i get a divorce now after 5 months, does he still get some of my pension and retirement. I have been on my job for 7 months. (i live in texas)

    I see language requiring the court to determine the spouse's interest in retirement plans, and language which indicates that the court may divide retirement benefits, but I don't see language which mandates that outcome. Even if the court were so inclined, you could probably "buy out" your husband's share by assigning him other assets. Seven months of retirement benefits, even with a really good job, usually aren't worth much as compared to the balance of the marital estate.
