    Default How to Get Visitaiton After a Neglectful Mother Regains Custody

    My question involves a child custody case from the State of: Tennessee. In 2009 my husbands sister lost custody of 4 of her children to the state. To keep them from being placed in foster care the grandfather took custody. My husband took POA over the baby (she was 3 months old ). Just to help his dad out cause the other 3 was 2,3,&4 years old. So Yea he needed help. The mother received custody back in 2012 but agreed to leave her (now she is 3) with us. Dcs knew about the agreement and was fine. So on December 13,2015 the cops pick up the child (now age 7) from school because she had filed kidnapping charges on us. Crazy huh??? So we went to court and that charge was drop and a neglect charge was filed on her from my husband.They was trying to send us to mediation but her lawyer informed us today that she didn't want to agree with nothing. No visitation no nothing. The courts just found the biological father and he wants nothing to do with it. I just want to know can she really just deny us visitation ? What can I do ? She is still unfit , dating a Felon that just got out of prison for murder !! Living in a 2 bedroom with 6 kids . I just fear for my baby cause what she is being exposed to is not her norm ! So please if you know what I can do if I can do anything let me know. We go back to court on Feb 2

    This is not your baby. She revoked the POA which she was allowed to do. She had every right to pick up her child. She is NOT unfit legally. You and your husband should have filed for custody way before now. You chose not to do so. You may end up with no court orders for visitation or anything else. If you do not have an attorney then you need an attorney. How do you figure that she neglected her child? She made sure her child was in a safe place -- with you. Unless of course you were not providing for the child.

    ou need to contact CS. They placed the children and unless they advise to return children, she is peeing in the wind. They either will agree to allow her children back or advise police they are not to be given to her.

    The children were returned to mom in 2012 but this one remained under a voluntary agreement. Mom was free to stop agreeing.
