    Default Lodger Will Not Leave

    My question involves landlord-tenant law in the State of: Ohio

    I have a person in my house who is supposed to pay me $120 every 2 weeks for a room in my basement. She has been here for 4 months and is habitually and chronically behind in rent payments. She also had brought her dog along after she was here for a few weeks. The woman in question has an alcohol problem and I suspect some mental issues. She is also a serious thorn in the side of my other lodger who is always on time with her rent.
    I have told her she has to leave and now she is refusing to leave. The only things in writing that exist to document she lives here are a note I wrote for her to our local welfare department telling them she rents a room from me and a cancelled check I received from her brother for some of her rent.
    How do I get rid of this scourge?

    You give her official notice to move out, in writing. It sounds like you would need to give her two weeks notice since the rental period is two weeks long. If she does not move out, then file in court to evict her.

    Meantime, what ever made you think that renting out part of your house to a stranger was a good idea?

    Pursuant to O.R.C. Sec. 5321.17, Ohio recognizes and defines notice periods to end week-to-week tenancies and month-to-month tenancies, but does not speak to a bi-weekly tenancy. If there is no lease term -- that is, if this is simply a tenancy that is terminable at will by either party -- then I would either err on the side of caution and treat it as a month-to-month tenancy, or I would confirm with a local real estate lawyer that a shorter notice period is going to be upheld by a court. If there is a lease term, then you can attempt eviction based on non-payment of rent, but if the issue is that the rent is a few days late then the payment of rent by your tenant in response to a 'pay or quit' notice is likely to moot the issue.

    You can look for information about eviction on your local court website; here's an example from the Rocky River Municipal Court. The overall procedure will be the same from court-to-court, but local court rules can come into play. That court also provides sample 30-day and 3-day notice forms, for the respective purposes of ending a tenancy based upon its either being a month-to-month tenancy or for a violation of the lease agreement, available here.

    I had never met her until she moved in but she was an acquaintance of my other lodger. I am disabled and need to have lodgers to help pay my bills. At the time the bad lodger moved in she was living in a homeless shelter due to problems with her 30 year marriage and had been supposedly abused by her husband. I was trying to help someone in need but in hindsight I will always kick myself over this. She was only supposed stay until she could get on her feet but she will not keep a job long enough to do that. Her brother is a lawyer and has offered her a place to stay in his luxury home but she won't go because I think she would have to clean up her act to so. Such a rotten person.
