    Default Failing to Report to Probation for Several Months

    My question involves criminal law for the state of: Texas. I've been working for a while and been busy. I've tried numerous times to call and get a hold of him. My original po left and I have a new one now. I can't simply go visit him mainly cause I work to much. I have a possession of a controlled substance; marijuana. I had resin from a pipe I had scraped. I served 9 months in jail, and been out since with no incidents. It's has been at least 5 months. What could happen? Also, statures of limitations?

    What can happen is that you can be resentenced for your crime, and spend time in jail.

    No, you don't have a statute of limitations defense to blowing off probation.

    You should consult your criminal defense lawyer about your poor choices to see if there is a way you might be able to avoid jail.

    And while I was writing you added that you're on parole. Your choice to violate your probation could also be grounds for a parole violation proceeding. Work with your lawyer, the sooner the better.

    Working too much is not an acceptable reason for missing your requirement to report. Sometimes you may have to miss work so you can report.

    So far you are risking having at least your probation revoked which could very well result in a parole violation. Unless you enjoy time in prison do anything it takes to resolve this situation would be a good idea.

    Yes you should be worried, very worried.

    What I would be worried about the most right now is it may already be too late to keep this from sending you back to jail or prison.

    There is quite likely a warrant for your arrest already. If you want to wait until you get picked up it is surely going to put you at a disadvantage. Being proactive always gives you more control over the situation than being reactive.

    I wasn't on probation, but I will do.
    I was wondering how stature doesn't apply to me.

    You weren't on probation but you were asking what could happen for failing to report to your probation officer. You make no sense.

    the title of your thread speaks of probation. Did you title the thread?

    so, are you on parole only and not on probation at all?

    Regardless, you need to do whatever it takes to get in touch with your parole officer and/or probation officer. Not reporting when required to is cause to revoke probation or parole and you can end up in jail or prison for not reporting as required. I have known guys that went to jail for missing a single report by a couple days. You are months late. I would not expect your PO to be all happy with you right now.

    I can understand why people who have not been in the criminal justice system don't understand the distinction between probation and parole, but somebody who is on parole should know the difference. Probation is through the county court system, and applies to those sentenced to jail or probation -- a county-level disposition. Parole is through the department of corrections, and applies to those sentenced to more serious offenses or longer terms of incarceration.

    This makes no sense. You state that you're on probation for weed. That's not something that you're going to be sentenced to prison for. You state that you have a new PO and you did have contact with the original PO prior to you failing to report. Then, you state you're not on probation but, somebody told you that you were.

    In my opinion, no, you should definitely NOT be worried. This has to be a poorly constructed, made up scenario.

    I agree with that -- a person who is convicted of possession of marijuana based upon "resin from a pipe [he] had scraped" and does time in the county jail is going to be on probation, not on parole.
