    Default How to Find Records of Ownership of Utility Poles Placed on Private Property

    My question involves an easement in the state of: New York

    Who or what profession can identify ownership of, and use of, and find records of, utility poles on private property?

    NYSEG says I have to seek an attorney. The phone-tv-internet company won't return calls. The surveyor says he'll take a look at the file (I paid for a survey) but seems to shy away from being responible for that information.

    None of the deeds address the issue.


    Here's what it is:

    A lot measures 70' x 1000' consisting of a front lot, middle lot and a rear lot. I own the front and middle lots, and the rear lot was recently purchased by someone else. A right of way runs from the street through the front, middle and to the rear lot. There are four poles total on the front and middle lots, and one more on the rear lot.

    Typically they're marked by the primary owner (one of the utilities either the power or phone company) though other people may have license to hang their wires on the same poles. Get the pole number and call the utilities and indquire.

    In the event of an ice storm or heavy snow, the wood poles can snap like a twig. So who pays for the new pole?

    You need to create an "event" resulting in a "ticket" from these folks:

    It can be anything that might reasonably happen...

    Construction of a driveway (needs to be presented as imminent) within half a foot or so of a pole might do it. If asked whether your question is for planning purposes, the answer is "no, the contractor will be here next week". You can always change your mind about the "driveway" after the information you seek has been obtained.

    I have used a similar approch as a licensed surveyor over the years in getting public utilities off of their butt and into an actual discussion.
