My question involves landlord-tenant law in the State of: California
Hi guys, thank you for your help.
I signed a lease with two other room mates to stay in an apartment for 10 months. However, I want to move out because they are constantly partying, distracting, and leaving a mess every where to the point where I can concentrate on my school work. One of my room mates have had his girlfriend sleep over more than thirty time. I want to move out, but to exchange my side of the lease with another room mate, both of my room mates have to sign it.
I have found a room mate interested in taking my spot and wants to move in by next week. He is a very nice guy from Brazil. However my room mates said they didn't like him. I believe they said this because they think I will continue to pay the lease even though I'm not living there (I'm living at my parents house). So I feel like they will say No to all of the potential room mates.
In the lease contract it stated this:
"Persons staying in the premises for longer than two weeks must complete a rental application and be approved and added to Lease. Any person occupying the premises longer than two weeks or 20 nonconsecutive days out of the year shall be considered an unauthorized occupant. Assignment or subletting any part of the premises without Landlord's consent is strictly prohibited and shall constitute a non-curable breach of this Lease."
My room mates girlfriend has slept over more than 20 times, and there is a security camera right outside our door for proof.
I was thinking about giving him an ultimatum; either he accepts the room mate, or I send out an anonymous email to the landlord.
I'm conflicted on what I should do. Any help is greatly appreciated.
