    Default Petitioning for Naturalization with a Felony Criminal Record

    LPR since 2002
    Arrested for felony Theft (class C) in 2008
    Plead guilty to 1 count Felony Theft in 2009. - No jail-time, Just restitution, and no probation.

    2011 Arrested and charged for 4 counts felony Theft.
    2012 Found not guilty by Jury.
    2013 Expunged/set aside criminal conviction from 2009

    2015 Applied for Citizenship in May (Disclosed all arrest and convictions and expungements on forms)
    Finger printed in June
    Dec 2015 Interview. (Was so stressed out and Nervous as hell)
    Passed the civics and english test
    Application was Approved because i only had 1 conviction with no jail-time.
    Conviction works against you if you have more than 2 and spent more than 365 days in jail/prison according to the interviewer.
    I had to show proof that i did not go to prison, by providing certified copy of my sentence.

    Waiting for swearing in date now... Yay!!!!!!!!!!!!!!!!!!!!!!!!!!!! I am almost a citizen

    So relieved....

    By the way, i did not even use a lawyer.. As i consulted with some and they were giving me all different outcomes.

    Well it was correct for me.. you dont have to accept it.

    Convictions work against you even if you don't spend a second behind bars. A single conviction can be disqualifying.

    Ok sir, i am only stating what the immigration officer that interviewed me said.
    I am no legal expert.. i guess it all depends on the crime too.

    Also i do not have a legal question. I am just sharing my experience with the next person that will do a search on this topic. Like i did searches before my interview and did not find
    many help..

    Folks, please take the first post with a grain of salt. It does not reflect reality as it pertains (or not ... ) to immigration and criminal behavior.

    OP's scenario is possible based on the seriousness of the one conviction. He barely slipped through.

    This is what OP stated:

    The underlined wouldn't recognize "accurate" if accurate came up and smacked it in the face with a clue by four. Time actually spent in jail isn't the point. At all. Even if.

    You are correct. I was not going to nit pick his story and asses each element. I was simply stating his circumstances, though borderline can result in a favorable finding.
