    Default Can the Police Escort You Home After You Turn 18

    My question involves juvenile law in the State of: GA

    (I am 17 years old. I'll turn 18 in 10 months. I do not claim to be mature, but bare with me please.) Now, I'm not sure how well someone can answer my questions, but here it goes: (Introduction; ) So, I heard that once a minor turns 18 years of age, that he or she is considered an adult before the law. (not in all states, but yes in the state I live) And that means his/her parents are no longer financially or legally responsible for him/her. That should mean that when I turn 18, my parents should no longer be obligated to provide me with anything, and that I should be on my own. It should also mean that my parents can no longer tell me where I can and cannot stay.

    I do not believe I will encounter a problem where my parents try and evict me from their home once I turn 18. Our relationship is pretty good and I think I behave well enough for that to not happen.

    In an example of epic teenage stupidity, I decided I was going to run away from home. I didn't consider it until dad said I could go anywhere I wanted, anytime I wanted as long as I didn't come back. I thought he was being serious. Well, about a year and a half ago, I told my parents I was having thoughts of suicide. And let's be real, which teen who's ever walked the planet has never had thoughts of suicide? Being the adequately protective parents they were, they had me hospitalized and drug tested and all that jazz. Then I saw a counselor periodically for 4-5 months. I never had strange or erratic behaviors, never hurt myself, nothing. To kill the suspense, I ran away not too long ago. 24 hours after I ran away from home, the police showed up. I knew exactly what was happening so I immediately threw up a white flag and surrendered. They checked me and my surroundings for weapons, since they had been told I was suicidal. I was thinking these people were out of their minds. They were just doing their job and being cautious. I behaved, I listened, I obeyed, and I was respectful, so I was escorted home, and before being released to my exceedingly worried parents, was given a spill about how incredibly stupid what I had just done was. Thankfully nobody was hurt or got in trouble.

    Which leads to my questions:

    [In the state if Georgia]
    1. When I turn 18, can the police (legally) "escort me home" for no reason at all?
    2. When I turn 18, can the police (legally) "escort me home" based on a claim (regardless of probability to occur, or validity) that I might try and kill myself (or otherwise get involved in danger)?
    3. Can the police (legally) escort any adult anywhere against their will? (I know the police can haul people away for serious stuff like crimes and arrests, but can the police haul away an adult for no reason at all) (or because somebody else claims said adult is in supposed danger)?
    4. If the answer to 1 & 2 is no, (which I really hope and believe it should be) then what can I do if an officer tries to "escort me home" after I turn 18? I know it's not really a good idea to resist a police officer, but these people make mistakes like any other human. Isn't there an amendment in the bill of rights for that or am I mistaken?

    Once I turn 18 and graduate HS, I plan on moving away from my parents. It would really, really stink If I couldn't do that because of something I said and never acted on 2.5 years ago from the time I plan on leaving. Then again, most minors who post on these forums leave with a bowl full of stink because they didn't get their way or think the law was going to give them special treatment. It would be totally messed up if somebody could actually claim that an adult is in danger and have the police barge in and haul away said adult against his/her will.

    I would venture to say most of them.

    1.) No. Not for NO reason.
    2.) Possibly. If there is a valid reason to believe that the person is in imminent danger of self-harm, or harm to others, yes.

    2 & 3. If the police have reason to think you pose a risk of serious harm to yourself or others they may take you into custody and transport you to a mental facility for evaluation and observation. What happens from there depends on what the medical staff there determines about your condition. They would not simply take you home. The police may also, of course, arrest you and detain you if they have probable cause to believe that you committed some crime.
    4. Once you turn 18, the police cannot just take you home. Doesn't matter the reason, with one exception. That exception would be if you were declared to be incompetent by a court and the court appointed your parents as your guardians. You are an adult at 18. Your parents, apart from that one exception, no longer control what you do.
