    You had better hope the judge believes you to be such an exceptional person, this was only the second time. Statistically you are a liar and that is what the judge will be assessing. Even if you are lucky to receive deferred adjudication, it will show up in most background checks and you will be carrying it on your back for life. hopefully, you will at least use your lack of judgment as a teaching tool for your children so they learn how dishonesty can affect their lives.
    I won't argue with you about what statistics say about me being a 'probable liar' as it looks like you've done your research. I only know myself, and know that I am NOT lying. Which is why my attorney said it is HIS job to let the judge, and prosecutor know who I am as a person and the circumstances surrounding my offense. Yes I will obviously hope for the best, who wouldn't?? And you can be sure I absolutely WILL use my personal lack of judgement and my bad choices as a learning tool for my children in the future. They will be able to see first hand the consequences of making bad decisions and hopefully I can teach them to never make the same mistakes I have. I am fortunate enough in my life that in the amount of time it will take before this could adversely affect me in the future, my attorney said by that point he would be able to help me get it expunged, or evacuated, not sure how he worded it.

    I'm really done arguing back-and-forth and defending whether or not someone committing a petty crime is a mistake or not. I came on this forum looking for any legal information or personal experiences that someone might have or be able to share regarding this same type of situation. Do you have any?

    Why didn't you just say so in the first place? We could have been much more helpful if you'd told us what you were looking for earlier on.

    Ok, I know someone who had a neighbor who had a brother-in-law, and the brother-in-law's sister's cousin got arrested for a second shoplifting offense in another state, and I heard that when she went to court, the judge seriously said "No big deal!" and let her off with just a warning .... for a second offense! No record, no fines, no jail!

    Is that what you want to hear?

    Oh YES Mr. Deputy Dog! That's EXACTLY what I asked! I asked if anyone knew of a friends cousins sisters brothers aunt who had been thru this same experience?? Didn't I?? You're a bully, and I'm starting to suspect a troll who has nothing better to do with his time than sit online and harass people. For any who were TRULY interested, I thought I'd update you.

    I had court today finally, and the city prosecuting attorney offered me a very generous deal which I accepted. The terms of the offer were: I plead guilty today to the misdemeanor theft charge, pay a $500 fine, $100 probation fee and $43 conviction filing fee. I attend a class about shoplifting, have 2yrs to pay my fines. If I get in to no criminal trouble of any kind in the next two years then the guilty verdict is stricken from my record and I get to go on with my life having no criminal convictions, just something showing there was a charge against me, and that it was dismissed. So obviously, I accepted this very generous offer.

    When I got up to the stand to give my plea and talk to the judge, she told me she doesn't usually see someone with my age, with a family and children etc... in there for stealing things like makeup from Sephora, and especially with my same trouble 5yrs ago, and asked if there wasn't possibly some other issue behind it all. I explained to her that there are as she suspected some underlying emotional and mental issues behind everything in my life right now, that I don't understand myself why I did it and that I'm in counseling trying to get help with those issues.

    She was very impressed with the fact that if sought counseling on my own accord and removed the stipulation for the theft awareness class, and said I didn't need it. I don't have to take it. She just gave me a slip to give to my counselor to report to her every 90 days that I'm still receiving treatment, and will continue to do so until my counselor seems it appropriate that I no longer need treatment. Which is FANTASTIC for me, I love my counseling appointments, they are benefitting me in many ways and it keeping me from having to spend half a Saturday in a theft awareness class is just an added bonus.

    You know, I KNOW what I did was wrong, I wanted to makeup for it in whatever way I ended up having to, I was ready to take my punishment. But for ALL OF YOU who said this was "NOT A MISTAKE" ...that I was just a selfish thief looking to make excuses for myself... Well, the judge disagreed with you. Maybe don't be so quick to cast stones at someone the next time they post on here looking for advice.

    Well as you can see from my updated posts on my results in court today, the judge disagreed with you, in fact, MISTAKE was the exact word she used when she described to me what she felt I'd done.

    Refer to my post about my outcome, if you care to. If not, don't. Forums like this, and comments like that are for online trolls like you, who would NEVER qualify to sit in a seat as an appointed official to judge someone.

    Just wanted to update you on my case since I went to court today and you had shown such genuine concern.
    You can see from my post what happened today. Everything turned out very well considering the circumstances. I hope you've had some good luck in your case as well.

    Meh. You're still a thief, any way you want to sugar coat it.

    I recommend you stay out of stores and do your shopping on line.
