    Default Intoxicated Manslaughter

    Got a couple of questions about my intoxicated manslaughter charge. I was charged with Intoxicated manslaughter, in texas. I was 17 at the time and took a plea bargain, under advice of a lawyer. My sentence was 9 months in a alcohol treatment facility, 10 years probation, 10,000 dollar fine, 240 hors of com. services. Currently i am 8 years into my probation and have paid my fine off, and met all of the other requirements. Originally I was told by my lawyer if took care of business he could get me off of probation after a third of my term. Recently I had my lawyer wright a letter to the judge, asking for early release. The request was denied, with the judge stating that because of the nature of the crime he could not grant it. Any advice would be appreciated.
    Also my Grandparents are trying to retire from the Bail Bond business and would like me to take it over. The only thing preventing me from doing so is my felony record. Is their any long term solution ( after I get off probation), like a pardon or something, so I can get licensed? Thanks again.

    Your request was denied unless there is an appeal process your dead. Far as bail bonds issue can a felon be a bail bondsman? I am unsure is Dog the Bounty Hunter a former felon?

    As the sister of a young man who was run over by a drunk driver over 14 years ago, I'd say your sentence was pretty light. If I were you, I'd just be grateful to only have 10 years probation than to bother thinking of getting off sooner. I realize your crime was probably not intentional, but, believe me, the family of the victim of your crime are still paying a much higher price than your sentence.

    In Texas, Intoxication Manslaughter is a 2nd degree felony, after all, you did kill someone. You got a VERY light sentence. As Texas has been cracking down on DWI/Intoxication charges, it is is unlikely that you will be able to get out of doing your full probation sentence, and I doubt you will ever be pardoned on a guilty plea of a 2nd degree felony.

    You need to explore the options of an expunction or a pardon and your best bet would be to contact a Texas attorney that deals in such post-conviction matters. Until you actually complete your probation it is unlikely you would be able to obtain such relief, though. If you satisfactorily complete your probation that fact of rehabilitation is something that can be used in support of any claim for relief that you may pursue.

    Being the younger sister of a person who pled guilty to the charge, I can say that I ordinarily would not remind you that you were responsible for a death (even if unintentional). My sister was sentenced to eight years, even while very far along in a pregnancy. So, you should just be appreciative that you received a light sentence. I hate when I see people who get off easy and try to rid themselves of the charge or get it pardoned. People like this are playing a part in the parole of others, especially people like my sister who made a change and actually DESERVE probation.

    As of October 14, 2009, I have been offically been released from probation. Now begins the uphill battle of clearing my record. Thanks for all of your help and advice.

    Congratulations on keeping yourself on the straight and narrow. You owe it to your victim to stay that way. Now take Litagators advice and find an attorney that specializes in expungements.
