my son was sentenced to 1 year of probation with a 4th waiver included (police could search without a warrant). The year was up over a couple of months ago.
How are the police made aware that they cannot search without a warrant anymore? does the system automatically purge the details re the probation, or does my son have to petition the court to make law enforcement aware that probation is completed?
If your son has successfully completed probation he should be given a certificate of completion and/or notice from the court or his Probation Officer notifying him of this. If the police continue to detain and search him, it is likely because he is NOT off probation. Or, the Probation Department has neglected to modify his status reflecting successful completion of probation.

It is possible that yur son is not telling you the whole truth.

Thanks for the reply, but... assuming the probation was not over, and he would get pulled over on a traffic stop, wouldnt the officer see the active probation and 4th waiver? if so, then what happens when probation is over?
If it is over and he checks your son's name, it will not come back with a hit on any probation status with search conditions ... assuming the records have been updated by the Probation Department.

Therefore ... the court record you see online is NOT the complete record.

This is your SON's issue, NOT yours. Your SON can speak to his attorney, his Probation Officer, or anyone at the Probation Department and try and find out the status of his probation. It is HIS issue, not yours.
