My question involves criminal law for the state of: Alabama: Someone I know ( we will refer to them as "B")and have known all their life has been what I believe to be FALSELY accused of sexual assault by a young teenage girl ( who we will refer to as "C"). This teenage girl was fostered and given custody to the accused sister (refer to as "A").
Of course A and B have know each other all their lives. B is 26. I have known them all their life. I do not know C. Her and her older sister come from a troubled home. A believing she was doing right by helping the young sisters out of the situation they was in has only brought chaos and drama into her home. And now this by accusing B to have put their arm around her shoulder, poking her belly button because she was told to put clothes on and told numerous time that she is to young to dress so promiscuous. Also that C said B pulled her down onto B's lap.
Like I said I know "B" and that is not their character. Telling "C" to cover up her belly button yes! Pulling her down NO! A journal was found belonging to "C" and has entries of her crush on "B". Also that "B" did not like her but didn't know why.
"B" is still sitting in jail because the money factor. Money has been scraped up to hire a lawyer, but the lawyer says if offered a misdemeanor they should take it because they won't win against DHR. So should the lawyer be dropped and hire a public defender? And what can we do to prove this girl has claimed these false accusations?
"B" had a rough start at a very young age. That's why "A" had it in her heart to try and help make things better for
"C". Now because of all drama caused by "C", "A" has been threatened by DHR to take her biological children away. Reason that the small children will be placed into foster care much faster than the older children . "A" also has had to retain a lawyer. Having these sexual charges brought on was just the ultimate final straw to all other claims and lies told by this troubled girl. How can she get the help she needs instead of hurting people cause of her not getting her way?
