    Default Gaining Contact and Visitation Rights After a Long Absence

    My question involves a child custody case from the State of: Missouri
    I am a non-custodial parent, mother and i were never married, child support established since a few months after birth, signed/notarized acknowledgement of paternity. My daughter who is now 6 resides in Colorado with mother and her husband. Mother has sole legal and physical custody. Visitation never established. Mother and daughter moved out of state 4 years ago. A few months ago mother and daughter moved back to Missouri and i was able to see my daughter for the first time since she was a baby (amazing). Mother would allow me and daughter to see each other on the weekends to spend some time together, even had a birthday for my daughter at my house with her grandmother she never met. Daughter was able to meet her family from my side for the first time. After a few months, mother and daughter moved back to Colorado without a word. Mother wont speak to me. I miss my daughter. Would like to know what my options are or chances are that i could be able to send letters/gifts, have phone calls or if any type of visitation would be a possibility. Just looking for some hope. I have only seen my daughter a few times but i felt a connection, i love her so much. I have never been married and she is my only child. I don't want to believe it's to late for me and my daughter to have some contact and see each other again. The last time i saw my daughter(did not know it would be the last time) was at a park with her mom and the mother of my childs mom, i was yelled at by the grandmother in front of my daughter to sign over my rights, rights i don't believe i have because i never went to court for a visitation order. Adoption has never been brought up by the mother to me, i don't think i could agree to it now that i have spent some time with our daughter. Any information would be greatly appreciated.

    Yes, you certainly can file for visitation. Most likely you would have to do so in Colorado since it doesn't sound like they were in Missouri long enough to establish residency for jurisdiction purposes.

    Thanks for the response. Ok, i can file for visitation. Was wondering what my chances are in being granted any visitation/contact. I realize a lot of factors would determine if it were possible and i have not disclosed many details. I am basically a stranger to my daughter. Child support is being paid but i also owe.

    Your chances are excellent. You might have to start out visiting in Colorado, but over time, you would eventually get visits in Missouri.
