    Default Demand for Money After Texting With a Possible Minor

    My question involves criminal law for the state of: New York

    Hello everyone:

    Let me keep this brief. A few days ago I was contacted by someone on a dating profile. We exchanged numbers and starting texting, the girl on the site was listed as "18", I'm 23. As we texted, she revealed that she was only 16, and I know that what I did was horrible, I did sent an inappropriate message afterwards. I knew I shouldn't have done it from the start and smelled something fishy, but in any case, I got a call from her "father" the next day. He said that he would go to the police unless I sent him about $360. I was about to, but I looked up her daughter and I discovered that her pics was well over two years old and of a different girl. In other words, they were scamming me.

    My question is: Can I get in trouble for this? I told the "father" that what he was doing was illegal and he said that I better lawyer up. I know that a lot of people will hate me for this and say I deserve what I get, but would I get into legal trouble, even though I never really even texted this girl?

    Have we established for certain that it actually was a 16 year old girl and not a pair of forty-something guys pulling a scam?

    I'll go into more detail. First and foremost, the "girl" on the dating site called herself Morgan, and so did her "father" on the phone. However, I plugged her pics on google images (nothing inappropriate btw) and they pulled up a social networking site where the same girl was wearing a jersey that said "Tatianna." Furthermore, her profile was named Tatianna. Another thing is that the reaction of the father didn't really seem legit. He pulled "the mother" into the phone convo at some point but when she spoke to me, she didn't seem angry or upset in anyway, like she was just saying lines. This kind of scam has occurred before.

    No kidding.

    That's why I suggested it might be a scam. And if it's a scam, how do you think you're going to get into trouble for it? YOU'RE not the one doing any scamming.

    I know what I did was really bad, but I've never been in trouble with the law before and I have no experience with the system. I don't know if they'll go to the police out of spite; we both suffer.

    If she wasn't really a 16 year old girl, what exactly is it that you did that you think the police would care about?

    Thank you for your replies, cbg, they made me feel at ease. I did some more digging all night and I found out that this is a very common scam. In fact, some people reported on other forums their text correspondence with these scammers and, I kid you not, some of the text was word-for-word the same as what I got. Apparently a lot of these scammers are based out of SC, and the phone that he called me with had an SC area code. I blocked his number last night and hopefully none of his buddies will try to scare me.

    Suffice it to say, I got what I deserved and I learned my lesson.
