    Default Can You Accuse the Custodial Parent of Fraud to Avoid Paying Support Arrears

    My question involves child support in the State of: Florida.We had to borrow $200 from my parents to pay my husband's child support because his psychotic ex wife is getting away with money that she is not owed because his ex wife's mother had custody of their daughter. She lied to child support and had my husband's DL suspended and he lost his job because of her! He was just starting to make small payments because it's all he could afford. We are trying to see if we can claim child support fraud on her and make her pay back her mother all the money she collected when it should have been the grandma. Also, split the support payments between my husband and his ex-wife to pay the arrears to HER mom for taking care of their child. Their daughter is 18, lives with her boyfriend and they have a baby together. Any advice on how and where to handle this?

    1. Your boyfriend is in arrears, clearly - exactly why and for how long wasn't he paying?

    2. If Grandma had custody, why didn't HE go for custody himself?

    He owes the arrears, and there is no "fraud" going on here - it seems to be nothing but a simple case of Dad not paying as ordered.

    Grandma is not and will never be told to seek child support from her daughter.

    I'm still at a loss as to how Mom is at fault because he didn't pay and lost his license and job for non-payment.

    If he had been paying like he should have, he wouuldn't have lost his license and his job. It takes more than someone calling support enforcement to get someones drivers license suspended. He still owes the child support that he didn't pay, even though she is 18 now.

    How long have you known him ? Why didn't he go to court and ask for custody, like Dogmatique mentioned ? He's going to have to pay it and if he doesn't, the IRS will take his refund check.

    Ooooh good point. He best be ready for that, too.

    Essentially this is as Mercy and I have already said, a very simple matter.

    For whatever reason, Dad didn't file for custody when his daughter was living with Grandma. Instead he chose not to, and just kept paying Mom but even if that wasn't the case he would have been paying Grandma the same amount and he still wouldn't be able to force Grandma to file against Mom which leaves him with a child support debt owed by him and only him. Mom owes nothing because she was never ordered to pay anything.

    That's pretty much it, in a nutshell.

    (as an aside, do all exes magically become psychotic after divorce? Is that a freebie offered in every divorce package?)
