Default When Can Detainer Warrant Be Served

My question involves landlord-tenant law in the State of: TN

My rental agreement specifies late fee if received after the 5th. It also says "Written notice of non-payment is hereby specifically waived.". At what point of the month am I able to serve the tenant with a detainer warrant?

Default Re: When Can Detainer Warrant Be Served

You need to provide proper notice that rent is due and that the tenancy will be terminated if the rent is not paid. If you are in a county that is covered by your state's Uniform Landlord Tenant Act, it is necessary to comply with that Act in your notice; if not, you don't need to describe the reason for the eviction, but you must still give proper notice. You can only seek a Detainer Warrant after the proper service of notice, and the expiration of the notice period without your receipt of the rent.
