Default How to Get Rid of My Roommate Subtenant

My question involves landlord-tenant law in the State of: OH

I am the lease holder of a 2 bed 2 bath apt in Columbus, OH. One guy stepped into my apartment as per my friends recommendation as a roommate in September (transferred rent on Sep 14th, personal bank transfer).

His behavior is very rude and after 15 days, didn't leave and said will leave after another 15 days and finally ended up in being in my apt for a week over 2 months. Now, I am worried that he might not leave the apt at all and he made a personal bank transfer of this Nov month's rent on 4th of this month.

There isn't any written agreement between him and me. His behavior is extremely suspecting and he is using all my utensils without my permission. He is using the restroom and not cleaning it despite asking him multiple times.

I had spoken with landlord they said they cannot evict him as he is not on the lease. I called police they said, they can't tell him to go as he is my apt for more than a month .

I am on a month to month lease and wanted to get rid of him and so, may I know, if I can break my lease immediately and leave my apt right away to get rid of him? But can you please, suggest, if I can do it? So, that he leaves along with me as soon as I turn in the keys to the leasing office?

Since, there isn't written agreement between me and him, I don't need to tell him or give him any notice, since I am terminating the lease due to some personal problems? I am ready to move out to get rid of him.

Is that the only option? Do I can do anything else to get rid of him ASAP?

I am afraid that he might break something in my apt and I will end up in being responsible for everything. Please, suggest what options do I have on in here, so that I can get him out ASAP.

He's your tenant. You need to give lawful notice and properly evict him, or actually get him to move out on his own initiative. If you choose to end your tenancy, you can find yourself in the position where he refuses to move out and you continue to owe rent to your landlord for an apartment you no longer occupy.

My landlord informed me that the lease agreement is in between me and them. And so, if I terminate the lease and leave the apt, they informed me that will take care of throwing him out, if he still lives in my apt.

Court says, cannot evict him as I am not the owner of the apt.

Please, let me know, if I can do this? So that he leaves without any further issues for me?

You will still need to give proper notice to your tenant, as otherwise you can be sued for unlawful detainer. Beyond that, if you want to move out and let your landlord deal with it, and your landlord is willing to do so through lawful process, that would be an option. Find out if your landlord is going to charge you rent through the end of the period of time it takes to remove your subtenant, if he's going to name you to any eviction action if that proves necessary, and if he will be charging you for any attorney fees and court costs he incurs.

Nonsense. Odds are you spoke with a clerk (who cannot provide legal advice) and asked the wrong questions. If you can't figure out how to evict a subtenant, you will need to hire a lawyer.

now. We split all bills down the middle. Now the lease was up a year ago and we do a month to month. Before he moved in I was staying with a previous roommate, but after he moved I became the primary on the lease. Now with the roommate I have now we have growed apart and he does not respect me. I have subjected myself to one side of the house to the point where I'm over it. Talked to the landlord they, told me to writ e him a letter on the 10th stating that he had to be out in 30 days. He read it hasn't responded, come in and go to work as if I haven't said anything...what I want to know is what do I do next? In order to make him leave??? Someone please help...
