    Default Can I Get Emancipated and Move In With My Older Sister

    My question involves juvenile law in the State of: Oregon
    I am currently 15 years old and I turn 16 in March of 2016. My home life isnt a dangerous situation but its not a healthy environment. I don't see my mother often and she gives me no push in school and so many other things that would take too long to type, I am hoping to get my GED and where I live there is a state program where you can do your first 2 years of community college for free.
    Also, I am not planning on living on my own, I want to live with my 22 year old sister, if emancipation can't happen is there another possible solution to move in with my sister? Thank you if you can help.

    You can move in with your sister if your parents allow you to move in with your sister.

    You do not qualify for emancipation, which means that you have the ability to SUPPORT yourself without the aid of the state. If Mom (and Dad) agree, you could stay with your sister, however.

    The juvenile court in its discretion may enter a judgment of emancipation where the minor is at least 16 years of age and the court finds that the best interests of the minor will be served by emancipation. In making its determination, the court shall take into consideration the following factors:

    (a) Whether the parent of the minor consents to the proposed emancipation;

    (b) Whether the minor has been living away from the family home and is substantially able to be self-maintained and self-supported without parental guidance and supervision; and

    (c) Whether the minor can demonstrate to the satisfaction of the court that the minor is sufficiently mature and knowledgeable to manage the minors affairs without parental assistance.

    Why must your parents push you to school? You set an alarm or go to bed early. Go to school, by bus, bike or foot. attend classes. Come home and do homework. Start over again. If you need after school help, the school usually provides it on certain nights.
