    Question Getting a Public Intoxication Charge in Another State While on Probation

    My question involves criminal law for the state of: Colorado & California

    I used to live in Colorado and received a class A trespassing misdemeanor, which resulted in a year long probation term. I have recently moved to California for college (the Colorado city court knows this) and received a public intoxication ticket while walking back to my dorm. I have already dealt with the punishment for the university. What I am curious about is whether this public intoxication ticket is something I should worry about or get a lawyer for. I go to court in about a month.

    Some more background information is that I got the trespassing ticket when I was a minor, but got the public intoxication ticket when I was an adult. I just am very uneducated about the discrepancies in between states and what I can expect in court. I have no prior charges. Any advice would be much appreciated.

    In California, absent other circumstances simple (alcohol only) drunks are usually released without further action once they are sober.

    Were you under the influence of drugs as well, or "particularly troublesome" at the time?

    What code section (on the citation) were you charged with?

    Are you still on probation? Did you report your arrest to the probation department?

    I am still on probation yes and I haven't reported my arrest. Should I?
    And I was released the next morning without any issues because I wasn't being troublesome at all. The code on the citation is 647(f) PC

    Your terms of probation likely include to not get into any further trouble with the law and to report any such encounters.

    Is your probation being actively monitored in CA or is CO allowing to just report from there?

    It's a completely unmonitored probation. Initially we were going to end the probation before I went to college but the court never got around to it

    Someone must be listed as a PO for you or a contact within the Probation Department.

    And what were the terms of your probation? I'm betting they included don't get arrested again and probably contact the Probation Department if you have any contact with law enforcement.

    There is no such thing as an unmonitored probation. You may not have to report to a specific officer but, while you are on probation, there is a unit that monitors those defendants. If you are arrested for another offense, there should be a record of it that the department recieves and they will handle the arrest accordingly.

    So when I go to court in California will they know that I'm on probation in Colorado?

    I guess what I'm asking is what should I expect and should I get a lawyer?
