My question involves criminal law for the state of: Mississippi
Recently, my brother was taken to jail for disobeying a police officer and has to appear in court for this charge. The night he was arrested, a family member had called the police on him and my mother to leave my aunts house. They did leave and when the police arrived they were already down the street leaving, he called them back and they were trying to explain what happened and he refused to listen. My mother was talking to the officer (upset obviously) and my brother tried to calm her and he put the two of them in handcuffs.
He didn't even talk to my aunt or the family member that called. Another officer arrived and they were discussing what to charge the two of them with. When it came to my brother he told him he was going to be charged with breaking the curfew but then asked him how old he was. When he said he is 18 he said no well, you're going to be charged with disobeying a police officer. He was then taken to jail and stayed overnight and was bailed out the next day. He will be going to court for this soon and I'm wondering will this stand in court?
We haven't seen the police report to see what the behavior the officer says is disobeying an officer. But my brother has never been in trouble before and we feel the officer was angry at the the time and wanted to take someone to jail. He didn't even talk to anyone else regarding the reason he was called. We want the charge to be dismissed in court what can we do about this?
