    Exclamation Can You Get Emancipated from Smothering Parents

    My question involves guardianship in the State of: Florida.
    Hi I'm Alyssa. I'm 15 and I live in Florida. I'm hoping to get emancipated when I turn 16 in a few months. I know its hard to get emancipated... But what are my chances?
    I currently live with my mom. Recently I persuaded my dad to allow me to allow me to live with my mom full time and not visit him. My mom is very anti social. She doesn't allow me to have any type of social life or a life at all. I'm not allowed to join any sports at school. I'm not allowed to have social media or text/call friends. I cant even call or text my dad from my phone. She separates me from everyone. I'm not allowed to leave her home unless I'm going to school or work. I currently work at McDonalds. Only because its across the street from her house. She wont even allow me to spend my own money. She took my pay card and refuses to give it back.
    I have a way to support myself and a place to go. She's smothering me. Im not a bad kid. I may not have the best grades, but is there anyway I could leave???
    Emancipation seems like a smarter decision rather than running away. I'd do nearly anything to get away from my parents once and for all. Even older friends of mine say that I should do something about it.
    Is there a way???? Please help

    I'm almost positive that FL will only entertain an emancipation petition if the parents file it - and even then... "she won't let me have a social life" is not grounds for emancipation, nor is a job at McDonalds going to pay you enough to declare you financially independent. You'll be 18 in a couple of years. You'll live.

    Children and family services were contacted last year by someone at my school. Other things happened that id rather not share online.
    I've read about marriage being a way to get emancipated as well, but how would I do that? Would it work?

    If only one of my parents agree could I be emancipated? Could the other parent stop it?

    Yes, they will stop it.

    But you haven't read a single thread here about emancipation in Florida, have you?

    Unless BOTH your parents not only agree to it, but sign the petition, your chances are zero. There is NO chance whatsoever that you will be emancipated without that.

    WITH that, your chances are about one half of one percent.

    It is not necessary that both parents sign the petition, but either parent can oppose emancipation. Conspiring with a non-custodial parent to try to get emancipated against the wishes of the custodial parent is generally going to be a bad idea, even before we reach the fact that the petition is highly unlikely to succeed under those circumstances. (And that's before we get to the fact that you have not said word one about your plan for independent living and support -- theoretical jobs won't cut it.)
