    Unhappy Auto Repo or Chapter 7

    (Florida) I purchase a used in 2004 mistubishi in May 2005 with 26,186 miles on it. The whole contract at the end of the loan will be $43,131.60. The problem is the payments are $599.05. At the time of purchase I was making $10.45 per hour and receiving $850.00 a month in childsupport which was not court ordered. Advised dealership this at the time of purchase. Therefore, did not think loan would get push through. With my income. Dealer gave me a call and advised that they found someone with the same last name as mind for the child support. This made no sense because, my kids have a different last name then mind. Anyhow, when I call the finance company they keep telling me I had a Ford 2005 freestyle truck. This not my car. Compare the debit ratio to my income this loan should not have been approved. I believe the dealer commited some fraud to push the loan through. It is now 2007 I still owe $26,000.00 and tried to appraise the car with no damages and mechinical work needs to be done, just need tries and now the car is worth $6,816.00. I have advised the bank I'm not able to make payments for I don't recieve child support anymore and my living expenses have increase. Do u believe it would be best for me to do involutary repo or file chapter 7. This dealer has really taken advantage of me. What should I do? To protect my credit for the payments already showing late and my score at the time I got the loan was 496 with that in mind and the income do you think they commited fraud. My mother also purchased a van and the same bank denied her and she makes more money she is a teacher I'm a customer service rep. I feel they did not shaded stuff to approve the loan.

    A repossession won't make your debt go away. You should consider consulting a bankruptcy lawyer.

    Is there a possible way out of the loan if the dealer commited fraud or will the lawyer be able to tell me this without filing bankrupt? Do I need to file If this maybe fraud and I can get out of the contract?
