My question involves criminal law for the state of: Colorado
I am currently in probation for a 2nd DUI offense, however, I was involved in a rollover car accident last labor day, and I was given a Driving Under Restraint due to alcohol charge, along with careless driving and failure to remain at the scene. I fractured my back and had to have emergency surgery, and was put on a back brace for an undetermined period of time. Now, keep in mind that I ran from the scene with my back split in 2, and I basically collapsed in a nearby forest and could not move from there until rescuers found me about 3 hours later. My question is: will I be seeing jail time? My probation officer and I have a good relationship, and I was complaint and doing everything right up until the accident. Will my injury play a role on not going to jail? I was walking the day after surgery, albeit barely, and the surgeon said it was a miracle I wasn't either dead or paralyzed...this is my first violation, and I was given a court for the 29th of this month, should I hire an attorney or get a public defendant? Any help or recommendations would be appreciated, thanks.
EDIT - I have not been convicted of the charges yet, as the accident happened in a different county that I am doing probation, also, I let my P.O. know the very next day from the hospital about what happened, and she seemed kinda regretful when she informed me I had to go to court for a hearing, it was more of a thing she had to do from what I can tell. Should I ask her to put out a good word for me in court? Can she even do anything for me?
