    Angry How to End Court-Ordered Custody With Your Child's Grandparents

    My question involves a child custody case from the State of: Texas
    My parents have temporary custody of my 3 year old daughter and in the court order my visitations states when we agree upon the time. This has been going on for 2 years because my boyfriend is African-American and my parents do not agree with that. At the time they received temp.custody I was not financially stable according to my parents and they are also making other stipulations up such as me and my boyfriend must be married. Now I am not able to retain a lawyer because of cost but I do wish to get her back ASAP. I would like to know what are the steps I need to go through to get her back within the next year. Also is it possible to get her back in that time period.

    If the court awarded your parents custody, you're going to need an attorney - it's very possible that the court would rule against you without there being a significant change of circumstances which actually warrants a custody modification.

    We never went to actual court their lawyer drew up temporary custody papers and I signed them

    Yes there is a court order. Since they are not following it can they be held in contempt?

    How are they violating it? You have told us that visitation is permitted as agreed between you and your parents -- and that you presently cannot agree. What part did you leave out?

    You can bring a motion before the court seeking to terminate the present order, or seeking to modify the visitation provisions to an enforceable schedule. We're not in a position to advise you as to the steps, as you have not shared the background to the case, the procedural history, or nature of the prior court proceedings; it would be wise to consult a lawyer about your options, taking a copy of the present order with you to your consultation.

    if it is TEMPORARY CUSTODY, it will be easier to terminate that then legal custody.

    There's A LOT missing here to your story. You stated that you never went to court but your parents lawyer drew up paperwork that you signed giving them temp custody. I'm pretty sure that's not considered a "Court Order" but I have been wrong before. So what your saying is that you AGREED to hand your daughter over to your parents base completely on their opinion that you weren't financially stable? And now they won't allow you to visit your child because they don't agree with interracial relationships? Something just doesn't jive here.

    What you're going to need to do is take the paperwork you signed to a lawyer and have them look it over because I just don't think these papers you signed are what you thought they were.
