Even if you and your children aren't receiving food stamps, Medicaid or other forms of public assistance, you can't count on others keeping their mouth shut about you living there. And believe me, people know you and your children are living there. Hopefully your parents won't have a annual inspection any time soon and the landlord or apartment manager won't have any reasons to be in the unit.

Do the math, girl. He can't pay what he doesn't have. And I'm sure he'd like to have a sandwich or two more than once a week, and maybe occasionally be able to throw a sleeping bag on the floor somewhere instead of sleeping under a bridge.
My point being that he can't be expected to pay out every penny he earns; he needs to be able to retain at least basic living expenses.
What's stopping Mom from going out and getting a job? What's HER obligation to support the kids? Sounds as if her parents are doing it at the moment (and illegally at that) - if she's contributing anything financially, she hasn't mentioned it so far.
Oh, I know what you were getting at and I think you know my thoughts on Mom not working. He was paying her for quite awhile despite there being no court order - and she was perfectly fine taking his money yet now she wants to move out of state and claims he's somewhere close to unfit thus shouldn't have custody. Funny, he wasn't unfit when they got together. Isn't it just remarkable?
