    Default Should I Abandon My Car at the Tow Yard

    My question involves a traffic citation from the state of: Michigan.

    I was struck by a different tow company from behind and it totalled my car. the tow truck driver recieved a ticket so he was at fault for the accident. I suffered a sever concussion and was in the hospital for a few days. I had no idea what happend to my car. i assumed since it was destoryed it would be taken to a scrap yard, i would be notified to get my stuff and they would scrap it and id get like $100. That ignorance is my fault i guess but when i fin ally looked into where my car was (it had been 3 weeks) it was at the tow companys yard and they want to charge me $500 dollars for storage! of a useless hulk I only had no fault insurance so i dont think they will pay for it.

    I called the insurance provided on the police report of the tow truck that hit me. They said that that policy was terminated last year before the accident. My friend told me that they may have simply had expired insurance in the vehicle but have current at their location but they are being very rude/unresponsive. im already taking them to small claims for my car. Anyways i dont want to pay $500+ dollars for it so im considering just abandoning it. What are the consequences of this? i heard they can sue me,( worst case scenario for me) they will simply take possession of my car and what they please which im ok with, or do this. And i read on this forum that it was a civil infraction worth $50. (comment number 5) Please help they are charging $30 a day!

    One idea: Offer to sign title over to the tow yard in exchange for being released from their claims, and see what they say.

    You can consider suing the at-fault driver under Michigan's mini-tort law for up to $1,000 in uninsured losses. If you have their insurance information from the police report, sometimes getting that money is as simple as contacting their insurance company and documenting that you didn't have collision coverage.
