    Default What Late Fee Charges are Permitted for Leased Equipment

    We leased equipment and it had a faulty part the leasing company is trying to charge 46.00 for the faulty part and 30.00 a month in late fees. I have been talking to them since it happened. They said they were waiting for results from their technican on site to confirm the part was faulty the contracted technician already confirmed the part was bad. Can they charge 30.00 a month in late fees legally? All I can find is rcw 19.150.150 they say this does not apply to them it states rental late fees can only be 20.00 or 20% of the monthly lease agreement. I paid all the rent on time and paid the 46.00 for the part but they are now charging late fees on top of late fees. We can not find our original lease agreement and they will not send us a copy of it. Can they do this? Do I really have to pay late fees on late fees?

    rcw 19.150.150 is regarding a self service storage facility. Obviously not applicable to your situation.

    so, what is the equipment, what is the faulty part, and in the lease are you responsible for repair or maintenance of the equipment

    why do you have a late fee if you have paid your rent on time?

    Your post makes it appear that you are a business that leased equipment, not a consumer. Did you intend to post this as a consumer law matter?

    They don't have to unless you're engaged in a lawsuit and they have to present it as evidence to prove their case or you demand it in discovery to prove yours.
