    Default Failure to Attend Court-Ordered DUI/DWI Classes

    My question involves criminal law for the state of: Kentucky
    Hey, guys and girls. I've got a quick question about compliance with court ordered DUI/DWI classes (missing them).

    So far I've been fixing the problems caused by my very stupid decision to drive about 10 months ago.
    (completed) I was order to attend and pay for a Mothers Against Drunk Driving (MADD) Victim Impact Panel class.
    (completed) I was ordered to pay $1500 in court fees, fines, damages.
    (completed) I was order to pay for and be on home incarceration for a period of 30 days.
    (almost completed - 10/12 months) I was ordered to pay for and attend weekly DUI/DWI classes for a period of 52 weeks.

    My question is, I'm on the verge of being non-compliant with the last court order (classes) and was wondering what sort of repercussions might arise from this?

    Any ideas are much appreciated! (please don't just respond by flaming me for my criminal actions, this doesn't help anyone).

    Thank you in advance for any advice or information anyone might be able to help with!

    You could be sentenced to spend time behind bars. If you are going to have difficulty completing your classes by a court-ordered deadline, see if you can get an extension -- and ask sooner, not later. If you do get an extension, don't blow it. If you can't, do your best to comply with the order and, if you are not going to be able to complete the requirement on time, talk to your criminal defense lawyer.

    Thank you for the quick reply, Mr. Knowitall, I have two questions. Would it matter if this court ordered mandate was not a set time of completion, but rather a set week accomplishment by the institution without missing 3 days (days missed is the the issue I 'might' be facing, will quit my job if need be to avoid this and keep going to school)? I understand this could be a / 'the' major consequence of not being compliant with my classes and would cause me to have to drop out of college temporarily (will never stop going), but do you have any idea of what the average response is to this type of situation? I've completed all other tasks and this is my 2nd DUI, the only other charge I have on my record is a 1st DUI 4 yrs 10 months beforehand (officially 2 months before my 2nd would have been a 1st again). I've heard of the possibility of reapplying to the same program for another year without additional consequences, which would cost me another $1k on top of what I've already paid.

    Outcomes can vary significantly based upon such factors as your record, the facts of your case, the policies of the judge, prosecutor and probation office, and the personal views of your probation officer. Some probation officers are very accommodating if they believe that there has been a good faith effort to comply with the terms of probation and that the defendant is on the right track; others can be much more insistent that a probation order must be followed to the letter. If this is nonsupervised probation -- that is, if you were ordered to fulfill certain requirements without the supervision of a probation officer with the court verifying at the end of the term that you fulfilled those requirements -- it can be very difficult to predict what a given prosecutor might recommend or what a given judge may do without knowing what they have done in similar cases. It's thus important to consult with local counsel.

    Expect the worst and hope for the best, a fair assessment. Thank you for your insights Mr. Knowitall. I might need to start looking for a new job very soon .
