    Default Can a Hotel Refuse to Rent a Room to Somebody Based on Age

    My question involves juvenile law in the State of:New Jersey. Hi everyone i have a question that i could really use help with. I'm 18, and there's this convention in New Jersey i got free tickets for that i REALLY want to go too, and alot of hotels wouldn't let me book rooms because Of the mini bar in the room. I found an comfort inn, and i called them and the man i talked to told me they will book me a room without a mini bar and everything. My problem is, i live in miami. And I'm scared that what if i book the room and when i get to New Jersey they wont let me do it anymore. I'll be stuck there basically. Can they do that? And if so, is there anything i can do? (Also some suggestions would be awesome)

    They not only can refuse to rent to someone under 21, if I recall correctly in at least some states they must refuse to rent to someone under 21.

    i find it difficult to believe the law prevents a hotel from renting to a person under 21 since the age of majority is 18 in most states. It doesn't mean the hotel must rent to a person under 21 but just find it odd that a states laws would prohibit it.

    But regardless, they often refuse to rent to those under 18 since the contract is not binding on the child in many situations and the damages the minor may cause are essentially uncollectible in those situations.

    No "name brand" hotel in my area will rent to anybody without a credit card as well, even if you are paying cash. They want to be able to place undiscovered charges, including possible damages, on the card.


    As to your situation Ozymandias (a Watchmen fan?); yes, they could deny you the room when you got there. While you may have some (civil) legal action against them if they did, it wouldn't help you right then and there. I suggest you find somebody over 21 to rent a room for you. Yes, it's a pain in the rump but given the possible problems you could face I would think it a reasonable means to help avoid problems.

    I may be mistaken about it being law (it's been almost 5 years since I worked for a hotel) but I am not mistaken that a hotel can quite legally use their own discretion in who they will rent to.

    Click on the link and select the location of the hotel. Read their policies. If it doesn't say the age requirement then call and ask for the manager and get his or her name. If they say they will give you a room, I wouldn't worry about it.

    All require a valid credit card.

    Okay awesome thanks guys! And yeah im a watchmen fan lol. My only problem is, @jk no body i know could do it for me. Even though the person says i can book it i still don't feel comfortable going there then I'm not being able to book it, it'll be like home aloneXD. What about if my parents BOOK and PAY for the room online, and i go there? Can they still deny me even though I'm not physically with my parents?

    I understand your apprehension as being that far from any safe haven and alone can be a frightening experience.


    Yes, even if your parents booked it for you they could still deny your use of it if your parents booked and paid for it but were not going to be present.



    I would continue to work with the hotel in question, possible speaking with the manager of the place if possible, expressing your concerns and wanting to make sure there are no problems or surprises. The manager may be willing to send you an email or something you can show the desk clerk the manager is aware of the situation if there are any concerns (and they are not there at the time of check in). They may see it as too much trouble and not but given your apprehension, I think I would try.


    and asked previously; do YOU have a credit card? I can think of a scenario where you having a credit card may be beneficial although they will have your parents card on record as where they can dump unexpected charges, having the person's card that is the one actually using the room may help assuage their concerns of getting stuck with a damaged room and nobody to charge.


    You might try contacting the hotels main offices as well so you know if this particular hotel is making a special exception or if their offer is a general policy of the chain. If it is a general policy of the chain, it is that much more likely you won't have problems.

    Update: a friend in nj will be able to do it, i can pay and he can just be there right? Does he have to stay? And if we checkout does he have to be there again?

    the questions you are asking are ultimately up to the hotel management to decide.
    but what kind of friend is it to not offer you a couch? (just kidding).
