    Default Who Pays for Medical Care if a Parent Has Not Carried Court-Ordered Health Insurance

    My question involves child support in the State of: Florida. How can a non custodial parent(Dad) force the custodial parent (Mom) to show proof of insurance?
    Dad pays $240 a month for insurance premium on top of child support. Dad takes child skating and child falls and fractures wrist "Shocker". Dad takes child to the ER, child has to be sedated to reset wrist, which required being moved via ambulance to another hospital with pediatric oversight. Dad calls mom for insurance information. Mom refuses and comes to hospital. When all said and done it is discovered that mom does not have insurance and hasn't had coverage for several months, if not longer. Because Dad brought the child to hospital he is being billed for services approx. $2600. Not sure where to even start with this one.

    If mom was ordered by the custody court to provide insurance for the child, dad can take her back to court on a show cause motion, asking that she explain to the court why she allowed the insurance to lapse. He can also seek reimbursement for the portion medical bills that he pays that should have been covered by insurance, had mom not let the insurance lapse. (e.g., if the parents would have had to split a $100 copayment had the insurance been in effect, with a 50/50 split of out-of-pocket medical costs, he should have only been on the hook for $50, so he can ask that the court order the mother to reimburse him for any amount he has to pay in excess of the $50.)

    If appropriate, dad could also seek to modify the order such that he is the parent who provides health insurance.

    Appreciate your reply.To the best of dad's knowledge, mom was released from her job and was unemployed for over a year. So the next question would be, in addition to filing a show cause motion for hospital expenses/bills. What would be the likely hood of him recovering monies spent for unprovided services? I would imagine zero.
    I see this is often, whether child care expenses or insurance expenses, etc. That are not actually applied or used for those services. You would think there should be some type of annual checks and balances for such. But we are talking about State ran programs.

    Bad communication between parents results from one or both parents choosing not to communicate well in regard to their children. There's no "state run program" that is responsible for the parents' unwillingness or inability to communicate.

    If mom has been unemployed for a year, dad certainly had a big clue that she would likely have lost her employer-sponsored coverage.

    Agreed with the communication part. Dad was not aware of mom not being employed. Poor communications skills is an understatement. How about zero. Hence the thought of checks and balances, for the unruly.

    Doubt Dad gets reimbursed for insurance not provided by mom ..unless his 240 was to pay in part for that coverage ....

    Dad pays set amount for CS. The 240 is his share of insurance premium in addition to CS.

    If Dad paid mom $240 per order as his share of insurance policy and mom failed to maintain the policy or even raise a big red flag and request a change due to a problem..that to me sure reads like a logical reason for Dad to get reimbursed in full...plus an order directing mom to pay all other costs as of there was a policy in place......of course one cannot squeeze blood out of a stone ...and if it's currently impossible for mom to pay you may be stuck to wait...Id suggest you ask for interest to be added?

    On what basis do you believe interest should be added?

    Unless a person pays his or her Bill timely, it sure makes sense to me to seek that interest be added..and if one anticipates slow,or late pay it makes sense to,have interest built into the order as it os unlikely it will happen unless ordered....
