    Default Can the Police Run the Plates of a Parked Vehicle

    My question involves police conduct in the State of: Illinois
    So an aquentence of mine was parked in front of my house, completely within legal rights. It was on the correct side of the road, close enough to the bumper and it was for a small amount of time during the day. Anyway, a cop scanned his plates and proceeded to go on for the day. He was off the clock, and had no cause to run the plates whatsoever. And then recently the same cop scanned his plates again at my house, although this time the car was parked in the driveway. Is this legal ? And once again, the cop was off the clock but proceeded to scan in the plates without probable cause.

    All very well and good. In fact around here the police cars and even the street sweepers have automatic plate scanners that go around wholesale looking for wanted vehilces.

    I'm curious OP, how you know they were scanned by the same officer or any officer for that matter? If the officer has automatic license scanners, they do not go off duty.

    There is no constitutionally protected reasonable expectation of privacy regarding a publicly displayed license plate number. An officer does not need probable cause to run a warrant or wanted check on a plate.

    U.S. v. Ellison, 462 F.3d 557 (6th Cir. 2006).

    State of Rhode Island v. Bjerke, 697 A.2d 1069 (R.I. Supreme Court 1997).

    Commonwealth v. Starr, 773 N.E. 2d 981 (Mass. Appeals Ct. 2002).

    And why are you so concerned about this? What has this "aquentence" of yours done that makes you worried if a cop scans his/her license plate?
