    Question What Are the Chances of Statutory Rape Charges if a Minor Becomes Pregnant

    My question involves criminal law for the state of: Massachusetts.

    Hi there guys i have a question so i just turned 23 and she turned 17 months ago, and she got pregant after she turned 17. we decided to have a baby. her pregnancy is just a a month old. and i want to know if it is legal for me to have a baby with her since the age of consent is 16 in Massachusetts. i would really appreciate your help, since i am not consideration and abortion. i am just confused right now and trying to find out if we will be find or not. I am willing to go through any hardship there is for my crime but the baby wouldn't have any fatherly love and support which scares and depressed me a lot. thank you.

    The girl is already pregnant.

    And I know what you're saying - I really do. But if there's nothing illegal about the act itself, it's pointless coming down so strongly on this guy or any other teen or young adult who is well past the age of consent.

    Unless he's enticed her over state lines, neither of them have done anything illegal. Icky? oh sure and I wouldn't be thrilled if it was my teen. But it's still not illegal.

    If the date of conception is past the age of consent, then obviously that is not of itself an issue.

    What evidence there may be of any unlawful activity prior to her reaching the age of consent, we would have no way of knowing.

    The issue isn’t the legality of being a father. No state makes being a father illegal. The issue is whether it was legal for you to have sexual intercourse with her. In Massachusetts it appears that the answer to that is no, so long as you did not induce her to have sex with you. Bottom line, it doesn’t appear that you’d face any criminal problems because of this.

    Note, though, that she is still a minor and subject to her parent’s control. Her parents could decide she will not see you any more, in which case you may end up not being able to be with your girlfriend until she turns 18. You’d still be able to see the kid, though, if you got the appropriate court order.

    Be aware that you have no control over whether she gets an abortion or not. That is her decision to make, not yours.

    Since when has grammar proficiency ever been proven to be a good predictor of how good a parent is? I know parents who are highly literare and great with grammar but who are truly lousy parents and vice versa. This kind of strikes me as a bit elitist.

    Going by OP's original post, it seems it happened after she turned 17.

    But it's a valid point, for sure.

    Legal or illegal, I am NOT going to tell a 23 year old that it's all right for him to, deliberately by the sound of things, get a minor pregnant. Even if it's with her cooperation.

    Because it's not. It may be legal. It's still wrong.

    It sounds to me like this is a long-term relationship, and that he's worried that the pregnancy is going to inspire a lot of questions.
