    Default Options After Confessing to Possession of a Friend's Drugs

    My question involves criminal law for the state of: New Jersey

    Hello, today a friend and I were arrested and the officer found a marijuana pipe and .25 grams of marijuana. They belonged to my friend but since he has a criminal record, I agreed to take ownership as long as he pays all of the fines. It will be my first offense. I was taken to the police station and my prints and picture were taken. The charges against me are possession of paraphernalia and possession of under 50 grams of marijuana. I am starting to regret doing this and worried my friend will not be able to pay the fines and I end up getting screwed. Is there anyway I can still get out of this or is it to late. Thanks

    Even if your friend owned the drugs, it's possible that you're guilty of possession by virtue of your being in actual or constructive possession of the drugs. Obviously, your confession is a big problem for you.

    You need to talk to a lawyer.

    .25g? Is this a residue or some flake? Or did you throw in a spurious decimal point? Definitely need an attorney but .25g is potentially an arguably small trace.
    Still the paraphernalia charge has similar penalties.

    What is likely to happen if I go to court next week without council for something like this? I mean it is my first offense and yes the .25 amount is correct. Is it really worth paying for a lawyer in this case?

    If you plan to recant your confession (and yes, you really should do this, a record is a record even if it's just fines, and even if your "friend" does reimburse you for said fines, you will still have a record that will have a negative impact on future employment opportunities and other things as well), then you definitely need a lawyer.

    I was told they would put me on PTI since it is my first offense and then remove the charges from my record once it is completed? Is that not correct? Thanks for all your replies by the way.

    What happens if I recant my confession? Do you mean tell them that it wasn't mine and that it was his?
