    Default Responding to a Summons

    I live in GA and received a summons from the Clerk of Courts for my county (Fulton), from the attorneys of a collection agency. The original debt was with Providian Visa, which was subsequently purchased by Aspire.

    I was confused as to why I'd received the summons, as I'd already set up payment arrangements (4 payments have been directly withdrawn from my checking account). I need to know how to respond to the courts (specific verbiage? specific forms?). Should I include copies of the amounts withdrawn from my account, as well? To note, the principal amount listed on the summons is $1,000 LESS than the original letter I received from the attorney's office, to which I responded and set up the arrangements. I assume I should mention that in the response.

    Lastly, when in the world did credit card companies/collection agencies begin sending brutes to ones' door for payment?!? What happened to hashing it out with the harrassing collection agencies?!

    Sorry for the long post and thanks in advance for any help...

    Did you make all of your payments on time? Does the amount stated in the lawsuit reflect the reduction in the balance from those payments? You were making the payments through the law firm which filed the lawsuit?

    Yes, all of the payments have been on time--they have done four direct withdrawals from my checking account. And yes, the payments were to the law office who filed the suit. All have cleared. The arrangements were made from October 2006 - March 2007 with the option to pay the balance (which I could not pay by March) OR continue with the monthly payments, at a higher rate.

    To note, the representative from the law office told me if all of my payments were made on time, they would offer a lower settlement amount, in March, to see if I could pay that.

    Then I would suggest starting by contacting the firm to see what happened.
