    Unhappy Former Employer Discovered Personal Files Stored On My Company's Computer

    My question involves labor and employment law for the state of California.

    My former employer discovered personal files that I stored on my company's computer. What legal action can they take? Some of my personal files were stored during working hours.

    Please help, if you have any insight?

    What kind of files are we talking about here?

    If you still worked for this employer you could be fired. However, unless you were storing child porn or state secrets on their computer, I would expect them to delete the files and go about their business.

    What is leading you to think there is potentially legal action involved?

    The personal files that I have stored on my company's computer were related strictly to my personal finances. I know that this was information that I should have NEVER stored on my work computer - I have learned my lesson for sure.

    I had no illegal content stored on my computer at all.

    My former supervisor contacted me directly to let me know that he made the discoveries and that he would be handing my files over to my former company.

    I left the company a month prior to his discoveries. I just wanted to know if they have any legal rights to pursue me in court for saving personal files on company's computer during working hours?

    Be glad he informed you.

    I was issued a laptop years ago that wasn't vetted as thoroughly, and I found a predecessor's resume, banking info, and social security number. Cookies revealed that he was doing a job search on company time. I had IT delete all the files securely and set up the laptop properly. It was a real eye opener.

    I see you've figured out how to respond to a thread.

    As I told you in my response to your PM, no, there is nothing for them to take legal action over. It *may* go into your personnel record; it *may* be part of any references they give you in future. But it is not something for which they would be able to take any legal action, even if they were so inclined. Which is doubtful.
