    Default Help with Building Contractor

    Im in tennessee.I had some water damage to a floor.I hired a contracor to fix it.He had done most of the work but not finished and askedto be paid.I paid him half on the the money.I had already gave him money for materials.Then he wanted to rest of the money but still wasnt done.I refused to pay until work was complete.He says he going to put a lien on my house.Can he do this?What will a lien do?What do I need to do about hiring someone to finish the job with out him trying to come back and finish to try to get the rest of the money?

    If he has followed the Tennessee mechanic's lien law, he can put a lien on your place.

    If he has not followed the Tennessee mechanic's lien law, he can sue you and, if he wins, he will get a judgment which can become a lien on your place.

    If either of those things happen, you will not be able to sell your place or get a loan on it until it is paid off or otherwise satisfied.

    Did you have a written contract with the contractor? What does it say about the timing of final payment?

    there isnt a written contract at all,just verbal.He said he would finish the job in 5 days.He started the job on Nov 1st 2006 and still isnt done.I have no problem paying him when he is done.Now I cant even get in touch with him.His phone has been turned off.So Im not really sure what to do now.Im afraid if I get someone to finish he will sue for the other half of his money.

    You can check at the courthouse. I would get two quotes from reputable contractors to finish the job. Issue a written contract and get on with it. You can send a demand letter to his last address CRR just to vcover yourself.

    what is a demand letter.what all should it say?what is crr?I ready to get my house back in order.

    A demand letter is a letter in which you present your demand.

    CRR means Certified, Return Receipt Requested.

    I just had the similar problem with a contractor
    and in my state the CC codes litterally state a
    licensed contractor MUST HAVE a contract
    with a minimum certain written stuff on the
    contract like

    1. Contractors name address and license #
    2. Date of work , completion
    3. Amount
    4. Both signatures on contract

    And a few other things

    The point here contractor is in violation of state
    code if he does not have something like the above
    so you can file a complaint with your State AGs office
    if he tries to collect AND you have similar state codes
    as mine> check your codes concerning licensed contractors
    and what they have to do concerning contracts to customers

    Just my 2 cents > been there before.
