    Default Receiving Full Custody when CPS is Involved

    My question involves child abuse or neglect in the State of: Florida

    My son was in my care when CPS was called on his mother. His mother was placed in county jail while CPS was looking and finally found me. CPS granted me temporary custody of my son but I didn't have paternity nor was I on the birth certificate. To complicate things more his mother was still legally married when my son was born. The court paid for paternity and he was proven to biologically be my son. However, custody has been delayed because the courts must find my son's mother's ex husband for him to sign away his legal right to my son.Divorce was finalized after he was born but the child was not part of the divorce. It has been 7 months and several court dates and they still haven't found him. Meanwhile, my son's mother has stopped showing up to court and visitations with my son. When and how can I receive full sole custody of my son? I would like to move out of state but I'm stuck waiting for this to be over.

    I hate to say this, but you're going to need an attorney. It's quite the complex mess you have there - but at least you have your son and he's safe. So get together some money at least for an initial consult or two.

    I was told by CPS and lawyers/advisors that work for the court that hiring a lawyer is pointless because it is in the hands of the county court at this point and I have to sit back and wait. Are they wrong? Can hiring a lawyer speed up the process?

    If it were me I'd have an attorney.

    It's entirely up to you though.

    If you want to spend the money, you can hire an investigator to try to track down the ex-husband/legal father.
