My question involves criminal law for the state of: Washington
First time offense, age 24. I purchased $40 from the store and was stopped 2-3 feet before I walked out the door by security personnel. An item had fallen out of my jacket and I had picked it up and was headed for the door. The security staff reached in my jacket and smacked the back of her hand against my stomach, causing a package to crinkle from inside my shirt. She then flipped her badge in my face and took my arm and indicated that we were going to be having a discussion and started pulling me towards the store office. I said okay and asked her to stop touching me and she said no and tightened her grip. I said "I'm cooperating with you, let go of my arm," and she said "No, I have every right to do this," and moved her grip to my jacket sleeve instead but was still putting her hands on me roughly. At one point I offered to purchase the stolen merchandise, which totalled $60, to which she said "There will be no civil compromise." I was given a piece of paper saying I was banned from their chain for life. A cop came and didn't ask questions, just placed me in handcuffs. I was placed in the back of a cop car and off we went towards jail. He read me my rights. I started blubbering random things at him basically to make him like me and he said he wasn't going to arrest me but gave me a citation and said that I needed to go to court; turned around and dropped me off at my car.
I don't know where to proceed from here. I'm obviously guilty-- otherwise I wouldn't have been detained, arrested, given a citation. But I would like this to not be on my record so I can find a job (it's hard enough out there) and hopefully pay as little money as possible. All the merchandise was returned, I cooperated fully and apologized for the lapse of judgement. I know a lot of this rests with what judge I get, but is there anything I can do to have as minimal damage as possible? Court is in two days.
