    Default Failure to Pay Misdemeanor Probation Fees

    My question involves criminal law for the state of: GEORGIA
    My husband was given the ok to move out of GA to TN because we were in a very sticky situation with our daughter and jv court this was in Jan 2015 he was up to date on payments till Apr 2015 and has been unable to pay since then he is a first time offender I am worried there might be a warrent out for his arrest in GA or TN but scarred to have him call his po my parent have offed to pay off his probation for him. Lastly if he had been able to continue payments he would be off probation as of Oct 2015 what is the likely hood of a warrent and what should we do!! We are also trying to get custody of our daughter back and have moved back to Ga because my parents now have our daughter

    When you choose to violate your probation, quite obviously you can face probation violation proceedings. If your husband needs time to make his payments, he needs to talk to his probation officer about the problem before he misses any payments. If he chose not to do that, he should speak to his probation officer ASAP, apologize, let his probation officer know when he will make his payments, and try to avoid a probation violation. Truly, if he has been in default since April and hasn't even bothered to speak with his probation officer, he's chosen to place himself at the bottom of a deep hole.

    When he was put on probation he had never broken the law he is a first time offender and has no real idea of how the system works it does not help that his PO is a real witch hates her job and is only into putting her clients back in jail she is a real peice of work

    If you have a probation officer who enjoys putting people into jail for probation violations, you are best served by not violating your probation.
