My question involves labor and employment law for the state of: Ohio
A department manager has been threatened with bodily harm by another employee. This harm was characterized by the aggressor to be fatal. The aggressor physically made contact and pressed the employee against the wall with his torso to provoke an altercation. The employee being threatened maintained composure to the situation with no physical response. The aggressor repeated attempts to provoke an altercation by entering the employee’s (managers) office.
This situation was witnessed by other employees. The Section Manager, who both employees report, was present and instructed the employee (Manager) being threatened he would be fired as well as the aggressor if he reported the incident to HR.
The Section Manager is currently retaliating against the threatened employee in response to the employee challenging to report the situation to HR.
The Section Manager is a previous union employee and close friends to the aggressor.
The threatened employee (manager) has not reported the incident given the Section Manager job threats as noted above. The situation occurred 1 week ago.
The retaliation involves placing the threatened manager in situations responsible for other employee plant safety while working him 18-20 hrs/day. The threatening employee has been given added privileges by the Section Manager.
Please advise any law that has been violated with any recommendations.
