    Default How to Recover Money for Vandalism of a Car

    My question involves a traffic accident in the State of: California

    Couple of months back my car and 3 other cars were scratched(wrote his name on the car with the scratch) by my neighbor's son in the apartment parking lot.
    His son wrote his name on 4 cars. When we spoke to him he said he will get it fixed soon. He kept delaying saying he is working with body shop etc.
    Finally he tried to fix two of the cars by some mechanic. Based on the result I said I will also do the same if it fixes other two cars.
    It turned out to be a temporary fix and the scratches re-appeared after next wash(these two cars are from other two neighbors).
    From my side I too took quotation from couple of body shop.

    Today morning when I said I have the quotation he straight away refused saying there is no proof that my son did it. To the fourth car owner he paid $500 to him. Owner of the car told me this.
    Now I am not sure what options do I have to move forward? Please help me understand what option do I have.

    Shall I go ahead and file a complaint. He says there is no proof but then he owned up and tried to fix the cars. It is only when he came to know these will no go away by polishing he is backing off.

    The vandalism should have been reported as soon as you discovered it, but you may do that now if you wish. Impossible to say what the cops will do with that complaint. You may also sue the kid that you believe did it in small claims court for the cost of the repair to fix what the kid did. There is always the problem of proving that the kid was the one who did it. The fact that he scratched his name into the cars is not helpful for him, and you may testify to the kid’s admission that he did it. Depending on your insurance coverage, you might want to make a claim for repair with the insurance company.
